Shops and establishments in Tamil Nadu permitted to operate 24x7 for another three years

On 8 May 2025, the Tamil Nadu Government extended the permission for all shops and establishments in Tamil Nadu employing 10 or more persons to operate 24×7 on all days of the year. This permission is effective for a period of three years from 5 June 2025, unless revoked earlier.

The permission to operate 24×7 is subject to certain conditions, including the following.

  1. Weekly offs and wages
    1. Employees are entitled to one day off per week on a rotational basis. This information must be recorded in the prescribed format and displayed conspicuously in the establishment.
    2. Daily records of employees on holiday or leave must be displayed conspicuously in the establishment.
    3. Wages, including overtime, must be credited to employees’ savings bank accounts.

  2. Working Hours
    1. Employers must ensure that normal work hours are limited to 8 hours per day and 48 hours per week.
    2. Overtime work must not exceed 10.5 hours per day and 57 hours per week.

  3. Engagement of women
    1. Women employees are not permitted to work beyond 8.00 pm under normal circumstances. Work between 8.00 pm and 6.00 am is permissible with the women employees’ written consent and subject to adequate protection of safety and dignity.
    2. Transport facilities must be provided for women working in shifts, and notice of the transport arrangements must be displayed at the establishment’s entrance.
    3. Employers with women employees must constitute an internal committee in accordance with the provisions of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

  4. Amenities
    1. Employers must provide restrooms, washrooms, safety lockers, and other basic amenities.

The notification specifies that violation of these conditions will result in penal action against the employer/manager. These conditions are similar to those prescribed in the earlier notification of June 2022 permitting shops and establishments in Tamil Nadu to operate on a 24×7 basis for a period of three years with effect from 5 June 2022.
